CUSTOMERS, DISTRIBUTORS, BUSINESS PARTNERS AND/OR SUPPLIERS
Técnica Mineral, S.A. de C.V. (hereinafter referred to as “TEMISA”), with address at Periférico Sur 6000, Artesanos neighborhood, postal code 45590, in Tlaquepaque, Jalisco, in accordance with the Federal Law on Protection of Personal Data Held by Private Parties and its Regulations (hereinafter referred to as “Legislation”), is responsible for the use and protection of your personal, financial and/or financial data that, derived from the business relationship, you provide directly to TEMISA, which will be processed under the principles of legality, purpose, loyalty, consent, quality, proportionality, information and responsibility in data processing.
Through this portal https://tecnicamineral.com.mx/ (hereinafter “this website”), we publish this privacy notice for the protection of personal information that may be collected from our Customers, Distributors, Business Partners, Suppliers and/or visitors through this website.
I. PERSONAL DATA TO BE COLLECTED.
- Identification data of individuals (full name, nationality, federal taxpayer registry, tax status certificate, valid official identification and in the case of foreigners, valid immigration form).
- Identification data of legal entities (corporate name, nationality, articles of incorporation and registration certificate, federal taxpayer registry, tax status certificate and power of attorney of legal representative and valid official identification).
- Contact data (proof of address, email, phone number, among others).
- Financial data (positive compliance opinion from the Tax Administration Service, account statements, bank statement header and where applicable, signed credit application).
The above information will be requested to the extent necessary for the provision of services derived from the business relationship in question, which will vary according to the service and terms involved.
Additionally, this website may collect standard registration information, including your IP address, browser type, language, access times and website addresses. Additionally, in order to ensure that this portal is being properly managed, facilitate better navigation and obtain statistics on the browsing behavior of visitors to our website, we may use cookies (small text files stored in the user’s browser) or web beacons (electronic images that allow counting visitors who have accessed a particular page and accessing certain cookies) to collect aggregated data.
Other personal, financial and/or financial data not mentioned above may be processed, provided that such data is considered of the same nature and is not excessive in relation to the purposes for which it is collected.
II. PURPOSES FOR PROCESSING YOUR PERSONAL DATA.
The data collected will be used solely and exclusively in accordance with the following purposes:
- Evaluation and identification as a prospective customer, supplier or distributor;
- Selection, evaluation and development of suppliers;
- Integration and updating of customer, supplier or distributor files;
- Negotiations and commercial interaction;
- Preparation of documentation such as contracts, agreements, invoices, receipts and all related documentation;
- Evaluation of financial solvency and compliance with credit obligations; and,
- Compliance with legal obligations derived from the business relationship.
If you do not wish your personal, financial and/or financial data to be processed for these purposes, you may expressly indicate your refusal through the contact means established in this Privacy Notice. Additionally, if it is intended to process personal data for a different purpose that is not compatible or analogous to the purposes set forth in this Privacy Notice, your prior consent will be requested.
Personal, financial and/or financial data will be kept in physical or electronic media for the time necessary to fulfill the purposes set forth herein and in accordance with applicable regulations, which will subsequently be discarded in order to avoid improper processing, in accordance with the provisions of Article 11 of the Federal Law on Protection of Personal Data Held by Private Parties.
In the case of customer or supplier termination, the collected documentation will be kept for 1 (one) year in virtual media and 10 (ten) years in physical form.
III. TRANSFER OF PERSONAL DATA .
By virtue of the purposes of this Privacy Notice and the procedures described above, personal data may be transferred to subsidiary, affiliate, affiliated or controlling companies of TEMISA, so that the personal, financial and/or financial data that is transmitted exclusively for the fulfillment of the business relationship may not be used in a manner different from that established herein.
We inform you that transfers of personal data will be made if necessary to meet information requirements and compliance requirements established by applicable legislation, without your consent, in accordance with the provisions of Article 37 of the Federal Law on Protection of Personal Data Held by Private Parties.
IV. SECURITY MEASURES.
All personal, financial and/or financial data that is collected will be safeguarded under strict confidentiality, in order to reasonably prevent improper use or disclosure, loss or alteration thereof, through the implementation of physical, technical and administrative security measures pursuant to applicable legislation, ensuring that only authorized TEMISA personnel will have access to your data.
V. MECHANISMS TO EXERCISE YOUR ARCO RIGHTS AND LIMIT THE USE OF INFORMATION.
In exercising the rights of access, rectification, cancellation or opposition (ARCO rights), as well as the right to revoke consent and to limit the use or disclosure of personal, financial and/or financial data, the data subject must prepare a request including the following:
- Name and/or corporate name and address;
- Valid official identification;
- In the case of your legal representative, prove their identity, as well as the documents that prove their authority;
- Contact means for future communications, such as email; and
- A clear and concise description of the personal, financial and/or financial data with respect to which you seek to exercise any of the aforementioned rights.
- In case of rectifying data, indicate the modifications to be made and provide supporting documentation.
The data subject who wishes to exercise any of the rights described above or to know the status of their request must send their petition to the email address legal@tecnicamineral.com.mx. TEMISA has a maximum response period of 15 (fifteen) business days, counted from receipt of the request.
VI. MEANS OF COMMUNICATION FOR CHANGES TO THE NOTICE.
This privacy notice may undergo modifications, changes or updates derived from new legal requirements, new or different practices, TEMISA’s own needs, privacy practices or other causes, so TEMISA reserves the right to make at any time modifications or updates that are necessary to this privacy notice.
Any modification or update will be communicated through official communication channels, either through TEMISA’s official website (https://tecnicamineral.com.mx/aviso-de-privacidad/), via email or to the WhatsApp of the holder of the personal, financial and/or financial data.
